A quarter into the 21st Century, the music business is more global, digital, and legally complex than ever before. To mark the launch of the IAEL’s 2025 Yearbook, Music Without Borders: Hot Legal Topics in the Music Business after the First Quarter of the 21st Century, this special ADE panel brings together the book’s contributors for a lively discussion on today’s most pressing legal and business challenges.Topics will range from how artist branding and superfan activities are redefining careers, while new realities in record deals and catalogue sales are transforming business models.Cross-border issues are also in focus - from taxation for artists and copyright termination beyond U.S. borders, to the intricacies of licensing with CMOs in Italy, music distribution in China, and the long-debated Atresmedia equitable remuneration case.A special spotlight will be on artificial intelligence, with contributors examining authorship questions, the EU’s AI Act, and the rise of avatars, live entertainment technologies, and AI-generated “companion celebrities.”With insights from leading entertainment lawyers spanning multiple continents, this panel offers a rare, inside look at how law and technology are reshaping the global music industry - and where we go from here

16.00 – 17.30: IAEL Legal Update for Entertainment & Technology

LOCATION:Felix Meritis (Room: Koepelzaal), Keizersgracht 324, Amsterdam

This session is your front-row seat to the latest legal happenings in the entertainment/music/tech industries across the world. Once again, legal and industry experts will weigh in on the hottest legal topics that defined 2025 and will shape 2026. This year’s edition will cover the legal impact of AI, including decided judgments (e.g. on the application of the TDM copyright exception and generative AI) and settled and ongoing lawsuits against AI companies from the US and around the world, as well as the licensing deals being hashed out to authorize data mining of copyright-protected entertainment content. We’ll discuss the rising value of name, image and likeness (“NIL”) rights in the music industry, including recent novel legislative efforts to protect NIL (e.g. ELVIS act in Tennessee, Dutch and Danish proposals for legislation on deepfakes, trademark registrations for faces and artist/band names), as well as legal issues arising from the use of NIL of dead artists for avatar concerts and videos. Further, we’ll address the status of the Pelham II case, pending before the CJEU with regard to the notion of “pastiche” and the impact of the Belgian National Orchestra judgment of the CJEU.
