An entertainer’s public persona and a brand’s reputation, often developed over many years, are exceedingly valuable assets and are legally protected in countries all over the world. But the level and nature of protection is by no means the same everywhere and may even diverge in different areas within the same country. In this Masterclass, experts from the USA, the UK, and the EU compare how each of their jurisdictions approach these rights including by discussing what is protected, the mechanics of enforcement and examples of how the law has been applied. The panelists also discuss best practices for protecting and licensing these rights, the impact of recent legal developments, and the challenges created by evolving technology.

15.45 – 17.45: The IAEL Main Seminar: The AI Revolution – The International Legal Perspective: Can the Law Save Humans from Creative Extinction by AI?

Expert lawyers from around the world will debate the major challenges presented by AI, and how the law is developing and how it needs to develop further, to harness the power of AI to both enhance and protect the creative industries. The speakers will discuss the current training and generative AI cases in the US and elsewhere; the clash of AI and copyright generally and how that is likely to resolve; whether there is copyright in AI output; the constraints that data protection laws place on AI processing; and how moral rights and personality rights can be protected in the generative AI process, among other things. The session will deliver essential know-how to lawyers and everyone else in the music industry.
